What comes first, Homestead exemption or my judgment lien that was filed first?
Q. I got a 750,000 judgment from a breach of contract lawsuit. I filed a lien against a nevada home. The owner, then after the fact filed a Homestead. The house is now for sale. When the sale is completed will I get my judgment paid? I did file my lien 2 months before the homestead was filed.

A. I don't know if they can force you to sell your house, but your equity in the home will be reduced. If your mortgage is $30,000 and your house is valued at $80,000 with no lien then your equity is $50,000. If you do have a $10,000 lien then your equity becomes $40,000 instead.

Now if you have been hiding from Capital One, they may have mailed you a summons or stuck in the door of an old address and asked the judge to rule service completed. It turns out that she might not own the property located at that address; her parents might own it.
